Is Trial By Jury An Anachronism?

Americans are guaranteed a trial by jury when facing criminal charges under the 6th and 7th Amendments to the US Constitution. However, recent events lead me to question whether trials by jury have sufficient integrity in the 21st century.

I have attempted to refrain from posting too much about the Clancy trial in Massachusetts. But the trial does illustrate that justice cannot be served when we have bad jurors whose attitudes and beliefs prevent them from arriving at the correct verdict.

Those attitudes and beliefs, unfortunately, are widespread in post-Christian America.

Let’s also think about the prospect that the Trump Administration might attempt to prosecute democratic socialists and/or Deep State players. It is widely understood that many of these cases would have to be heard before Washington, D.C. jurors; and that it would be extraordinarily difficult to get a conviction in that venue when crimes are committed.

Here is another issue. We have reason to believe some African-Americans might refrain from convicting other African-Americans.

If you don’t have people with integrity who can see the truth clearly and decide impartially, then the trial by jury system cannot work consistently. I will leave it to the reader as to whether we can rely on today’s jurors to arrive at the right verdict.

It is difficult to see, however, a better alternative to the trial by jury system.
