  1. If they can do it, then do it. Seems like a bit of an overreach. Do you eliminate those whose decisions with which you disagree and go through the appellate court and let the SCOTUS settle the matter. Levin mentioned Marbury v. Madison, a legal case in which, on February 24, 1803, the U.S. Supreme Court first declared an act of Congress unconstitutional, thus establishing the doctrine of judicial review. How do you think the Supreme decide a case in which Congaree abolishes the lower courts ?

    1. If this district court were eliminated, Fred, there would need to be a lot of thought about how cases would be handled that ordinarily are addressed by that court. Routine matters rerouted to other district courts? Cases with national political/ governmental implications straight to the appellate level? I don’t know.
