The Solicitor General can make a strong argument for upholding President’s executive order ending birthright citizenship. The case should be decided on the merits in the case — not just a procedural or technical question. SCOTUS will hear arguments this spring and render a decision in June. I am betting they decide in Trump’s favor thus overturning Wong Kim Ark.
“Subject to the jurisdiction” ought to make it clear. But with a Supreme Ct. that thinks it is just fine that state and federal law enforcement steal more money from Americans each year than ALL conventional criminals…through civil forfeiture–where they steal your stuff without charging you with a crime…with such a Supreme Ct, everything is just a role of the dice.
I think, J. Sobran, most people no longer believe that the courts always impartially weigh justice. Most people understand judges can be political actors. I hope they, at the very least, get the politics right on this question. If they get the law right– or the politics, for that matter– our side will prevail.
