Alan Dershowitz has an interesting take on why the various judges vacating Trump’s executive actions are deciding against him. I can’t help but believe that at least some of them are acting on the basis of their own misbegotten judicial philosophy and approach:

I agree, J. Sobran. I should clarify that there is an entire body of law and regulation that supports giving the illegal due process “rights”; but the Constitution— and the recently discovered Alien Enemies Act– gives the executive (i.e., Trump)– the power to protect our borders and thereby remove them. The Constitution does not support creating all these structures that intentionally frustrate the efforts of the executive.
