There is much discussion about how to correct all of the egregious wrongs we have witnessed being committed over the last 10-15 years. These have become almost too numerous to count– among the political left, in the Deep State, among the donor class, in non-governmental organizations, in tech companies and in the legacy media.
I will outline several potential mechanisms for accountability.
First, there can be suits or prosecutions at the state or federal level. These can be criminal or civil.
The advantage of pursuing civil cases is that a lower standard of proof is required, and a mere majority of the jurors is needed to obtain a judgment. Criminal cases require proof beyond reasonable doubt and unanimity among jurors– a more difficult standard to meet.
The federal courts around the D.C. area– that is, the US. District Court in Washington, D.C. and the D.C. Circuit Court of Appeals– have become progressive/ socialist kangaroo courts. They are quick to prosecute and convict conservatives; and they let the progressive/ socialist crowd off the hook.
There has been some chatter that Trump might even move to eradicate these D.C.-based courts. That would be a very important reform because all the major cases affecting the federal government are directed to these courts by default. If a Trump Attorney General were to bring actions in these courts, it would be very difficult to secure the decisions that bring true accountability.
Prosecutions and actions in state courts– or in federal courts outside the D.C. bubble– would have a better chance of success. But there has to be some pretext or justification for using those courts. My belief, however, is that these are better routes to obtain justice than the D.C.-based federal courts.
Of course, the cases against bad actors would need to be developed; but some of the preliminary work has already been done by congressional committees in some cases.
A second route of accountability would be military tribunals. This would be ideal for some cases. It can be used against military people who have transgressed. But it also can be used against civilians who have committed treason.
A third route of accountability is to pull security clearances from those within the past or present national security community who have abused their privileges. This would affect their ability to “cash in” on their prior government service.
I have heard discussed also a potential route to obtain accountability for the corrupt media. The major television networks– CBS, NBC, ABC, even PBS– get their broadcast licenses from the federal government. The major networks each own a limited number of TV stations. The suggestion being floated is to pull their broadcast licenses because they no longer serve the public interest; and to find other entities to use their places on the broadcast spectrum.
Trump and his crowd have a number of options at their disposal. Let’s see what they do with it.
These are some interesting and untried theories.
The bottom line, Fred, is that it would be very difficult to get convictions in the federal courts based in DC. They need to be creative seeking other means of attaining accountability.
