Yesterday, he announced he would not be running for his old seat on the state Supreme Court. The speculation is that Chief Justice Paul Newby might retire, and that Berger Jr. might run for Chief Justice. (Newby is approaching the state’s mandatory retirement age for judges).
As far as I can tell, Phil Berger, Jr. has done a very good job on the NC Supreme Court. He would make an excellent Chief Justice should Newby elect to retire.
